Terms of Service
1. Acceptance of Terms
By accessing or using BRIXI ("the Service"), a product of PIXEL & Mortar LLC ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
BRIXI is a business operations and communication platform for small and medium-sized businesses.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to: use the Service for any unlawful purpose; send unsolicited or spam messages; violate any applicable telecommunications regulations including TCPA; misrepresent your identity or business; attempt to access other users' data; or reverse-engineer any part of the platform.
5. SMS Messaging Terms
Use of SMS features is governed by our SMS Terms & Conditions. You are responsible for obtaining proper consent from your customers before sending messages and for complying with all applicable laws including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
6. Intellectual Property
All BRIXI software, design, branding, and technology are the intellectual property of PIXEL & Mortar LLC. You retain ownership of your business data. By using the Service, you grant us a limited license to process your data solely to provide the Service.
7. Payment and Billing
Subscription fees are billed according to the plan selected. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.
8. Data Privacy
Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your information.
9. Limitation of Liability
BRIXI is provided "as is" without warranties of any kind. PIXEL & Mortar LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 2 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless PIXEL & Mortar LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
11. Termination
We may suspend or terminate your account for violation of these Terms. You may cancel your account at any time by contacting Hello@Brixi.Tech. Upon termination, your right to use the Service ceases immediately.
12. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Wyoming. You waive any right to participate in a class action lawsuit.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
